PROCLAMATION

RE: PEELER CRAB TRAWLING-CARTERET AND DARE COUNTIES

This proclamation opens portions of Carteret and Dare counties to peeler crab trawling in accordance with the Blue Crab Fishery Management Plan Amendment 2.

Braxton C. Davis, Director, Division of Marine Fisheries, hereby announces that effective at 8:00 A.M., Monday, March 13, 2017, the following areas WILL OPEN to peeler crab trawling:

I. AREA DESCRIPTION

A. CARTERET COUNTY
1. Core Sound and Back Sound – an area south of a line beginning at a point 34° 59.5027’N – 76° 12.3204’W in Wainwright Channel immediately east of the northern tip of Wainwright Island; running easterly to a point 34° 58.6760’N – 76° 12.4164’W described in N.C. Marine Fisheries Commission Rule 15A NCAC 03 R .0106(1).
2. Cedar Island Bay – northwest of the special secondary nursery area line described in N.C. Marine Fisheries Commission Rule 15A NCAC 03R .0105(4)(a).
3. Nelson Bay – northwest of the special secondary nursery area line described in N.C. Marine Fisheries Commission Rule 15A NCAC 03R .0105(4)(c).
4. Brett Bay-north of the special secondary nursery area line described in N.C. Marine Fisheries Commission Rule 15A NCAC 03R .0105(4)(d).
5. Jarretts Bay – northwest of the special secondary nursery area line described in N.C. Marine Fisheries Commission Rule 15A NCAC 03R .0105(e).
6. Middens Creek – southeast of the primary nursery area line described in N.C. Marine Fisheries Commission Rule 15A NCAC 03R .0103(10)(g)(ix).
7. Bell Island Area southeast of the primary nursery area line described in N.C. Marine Fisheries Commission Rule 15A NCAC 03R .0103(10)(g)(xi).
8. North River – south of the special secondary nursery area line described in N.C. Marine Fisheries Commission Rule 15A NCAC 03R .0105(5)(a).
9. Wards Creek – west of a line beginning at a point 34° 46.3808’N – 76° 34.4765’W running southeasterly to a point 34° 46.0490’N – 76° 34.3077’W.
B. DARE COUNTY
Kitty Hawk Bay, Colington Creek and Buzzard Bay special secondary nursery area described in N.C. Marine Fisheries Commission Rule 15A NCAC 03R .0105(1)(b).
II. GENERAL INFORMATION

A. This proclamation is issued under the authority of N.C. General Statutes 113-170.4; 113-170.5; 113-182; 113-221.1; 143B-289.52 and N.C. Marine Fisheries Commission Rules 15A NCAC 03H .0103, 03L .0202, 03J .0104 and 03N .0105.

B. It is unlawful to violate the provisions of any proclamation issued by the Fisheries Director under his delegated authority pursuant to N.C. Marine Fisheries Commission Rule 15A NCAC 03H .0103.

C. Shrimp taken incidental to peeler crab harvest activities in areas closed to the taking of shrimp, must be returned to the waters where taken.

D. In accordance with Marine Fisheries Commission Rule 15A NCAC 03L .0202, it is unlawful to use trawls with mesh length less than two inches or with a combined total headrope length exceeding 25 feet for taking soft or peeler crabs in the above areas.

E. All Primary and Permanent Secondary Nursery Areas and Shellfish Management Areas remain closed to all trawling activity. In accordance with N.C. Marine Fisheries Commission Rule 15A NCAC 03N .0105 (b), Special Secondary Nursery Areas will close to all trawling at midnight on May 14, 2017.

F. All areas currently open to shrimp and crab trawling are open to peeler crab trawling.

H. The intent of this proclamation is to allow peeler trawling in waters listed in I. A and I. B in accordance with the Blue Crab Fisheries Management Plan Amendment 2.

I. In accordance with N.C. General Statute 113-221.1 (c) All persons who may be affected by proclamations issued by the Fisheries Director are under a duty to keep themselves informed of current proclamations.

J. This proclamation supersedes SH-1-2016, dated March 1, 2016. It opens portions of Carteret and Dare counties to peeler crab trawling.
